Information on the processing of your data

In accordance with the General Data Protection Regulation (DSGVO).

With the following information, we provide you with an overview of the processing of your personal data in the application process and your rights under data protection law.

2. What personal data do we collect?

In order to carry out the application process, we process the following personal data concerning you in particular:

  • Your master data: Last name, first name, name affixes, date of birth, nationality.
  • Your contact data: private address, telephone and mobile phone number, email address
  • Your skills: data on your skills and knowledge in relation to the requirements profile of the advertised position work permit/residence title, if applicable
  • Health data: as far as the proof of health suitability for the advertised position is required
  • Criminal record: insofar as proof of personal suitability is required for the advertised position
  • Other data: Permission to use the job title, evaluations in job references, work experience, salary expectations.

As a rule, your personal data will be collected directly from you as part of the recruitment process, in particular from your application documents and during the interview as well as with the personnel questionnaire. In the case of a job placement, we also receive corresponding data from third parties.

 

3. For what purposes and on what legal basis do we process your personal data?

We process your personal data in compliance with the provisions of the EU General Data Protection Regulation (DSGVO) and the German Federal Data Protection Act (BDSG) as well as all other relevant laws (e.g. BetrVG, SGB IX).

The data processing is carried out for the purpose of deciding on the establishment of an employment relationship on the legal basis of Article 6 para. 1 letter b DSGVO in conjunction with. § Section 26 (1) BDSG. In addition, the processing of data on criminal convictions may be carried out on the basis of Article 10 DSGVO in conjunction with. § Section 26 (1) BDSG, insofar as this is necessary to prove your personal suitability to perform the advertised activity. The processing of your health data may furthermore be carried out on the basis of Article 9 (2) letter h DSGVO in conjunction with. § Section 22 (1) BDSG for the assessment of your fitness for work.

If we want to process your personal data for a purpose not mentioned above, we will inform you in advance.

 

4. Who may receive my personal data?

Within our company, only those persons and departments (e.g. employees of the HR department, management, specialist department) receive your personal data who are involved in the decision about your employment. In addition, access by the IT service provider who works for us by way of commissioned data processing and is subject to a confidentiality obligation may be required. Data will not be passed on to third parties.

 

5. How long will my data be stored?

In the event of rejection, your application documents will be deleted no later than six months after completion of the application process. Longer storage will only take place if you have given us your consent to do so (e.g. for inclusion in an applicant pool).

 

6. What rights do you have as a person affected by the processing of your personal data under the GDPR?

  • You have the right, pursuant to Article 15 DSGVO in conjunction with. § 34 BDSG to request information from us about the personal data we have processed that concerns you. In this case, we will provide you with a copy of the personal data, if necessary also in electronic format. You also have the right to the information specified in detail in Article 15 (1) DSGVO. However, the aforementioned rights are not unrestricted; the limitations of these rights can be found in particular in Article 15 (4) DSGVO and Section 34 BDSG.
  • You have the right to have inaccurate personal data concerning you corrected without delay and incomplete personal data completed in accordance with Article 16 DSGVO.
  • You have the right, in accordance with Article 17 DSGVO in conjunction with. § 35 BDSG to demand the immediate deletion of the personal data concerning you. However, this right to deletion does not exist without restriction. In particular, deletion cannot be requested insofar as further processing of the personal data concerning you is necessary for us to perform the contract existing between us, to fulfill a legal obligation or to assert, exercise or defend legal claims. The requirements and restrictions of the right to erasure are set out in detail in Article 17 DSGVO and Section 35 BDSG.
  • You have the right to request the restriction of the processing of personal data concerning you in accordance with Article 18 DSGVO if one of the conditions of Article 18 (1) DSGVO is met. In this case, we may continue to store this data, but beyond that, we may only process it under narrow conditions. The conditions and restrictions of the right to erasure are set out in detail in Article 18 DSGVO.
  • In accordance with Article 20 DSGVO, you may request to receive those personal data provided by you, which we process by automated means on the basis of the contract existing between us or your consent, in a structured, common and machine-readable format. We are prohibited from obstructing the transfer of this data by you to another controller. In addition, you may request direct transmission to another controller by us, insofar as this is technically feasible. The conditions and restrictions of the aforementioned rights in detail can be found in Article 20 DSGVO.

We will provide you with the above notifications and measures requested by you free of charge in accordance with Article 12 (5) of the GDPR.

As a data subject, you have the right to exercise your rights pursuant to Article 77 DSGVO in conjunction with. § Section 19 BDSG, without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a data protection supervisory authority if you believe that the processing of your personal data violates the DSGVO.

You may revoke any consent given to us to process your personal data at any time. Please note that the revocation is only effective for the future and does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

 

7. Are you obliged to provide us with your personal data?

In order to be able to consider your application, we require from you those personal data that are necessary for the decision on the establishment of the employment relationship. It is not possible to carry out the application process without this data.
